By using the Rezform website ("Service"), and all services of Rezform, you are agreeing to be bound by the following terms and conditions ("Terms of Service"), including any subsequent changes or modifications to them. If you do not agree to these Terms or to our Privacy Policy, please do not access the Rezform website or services.

The term 'Rezform' or 'us' or 'we' refers to the owner of the website. Rezform is operated by MV TEST SOLUTIONS LIMITED. The term 'you' refers to the user or viewer of our website.

Privacy and Communications

You acknowledge and accept that Rezform may from time to time send you communications concerning your account or the Service via email.

Accounts, Passwords, and Security

You must be a registered user to access the Service. You hold the responsibility for maintaining the security of your password and should never disclose it to any third party. You are solely liable and accountable for any activity that transpires under your username.

Acceptable Use and Behaviour

You hold sole responsibility for your behaviour and your data related to the Service. You agree to indemnify, defend, and hold harmless Rezform and its licensors, and their respective directors, officers, employees and agents from any and all loss, cost, liability, and expense resulting from or associated with your data, your use of the Service, or your violation of these terms.

You, your company, and/or your customers are only to utilise the Software and Service for personal or commercial use. Usage must not breach or contravene any third party rights and is required to be in accordance with all relevant laws, rules and regulations.

Breach of this agreement through any unapproved use of all Rezform services, which may also be in violation of certain laws, could submit the unapproved user and their representatives to civil and criminal punishment.

Indemnification

You agree to indemnify, defend, and hold harmless MV TEST SOLUTIONS LIMITED, Rezform, and its directors, officers, employees, affiliates, agents, contractors, suppliers, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to legal fees) arising from:

• • Your use of and access to the Service
• • Your violation of any term of these Terms of Service
• • Your violation of any third-party right, including privacy or intellectual property rights
• • Any claim that your use of the Service caused damage to a third party
• • Your SMS communications with subscribers or any claims arising therefrom
• • Any data you collect, process, or share using the Service

This indemnification obligation will survive the termination of these Terms and your use of the Service.

Fair Use Policy

The fair use policy exists to ensure service quality for all users and to prevent abuse of our SMS verification system. Normal restaurant usage will rarely approach this limit.

Fees and Billing

There will be no provision of refunds for unused service at any time from Rezform. The user is able to opt-in to, and set the level of, recurring billing. The subscription will automatically renew at the end of the subscription period, unless expressly cancelled by the user.

The user must issue cancellations through the Service. To ensure there is sufficient processing time, all cancellations must be issued at least 72 hours prior to the end of the subscription period.

• • Starter Plan: $19/month - Unlimited subscribers*, unlimited pages, CSV export (*Fair use: 1,000 verifications/month)

Chargeback / Refund Policy

Under no circumstances will Rezform provide cash refunds. Please get in touch with our support team immediately if you have any queries in regard to charges made against your account. Your account or credit card will be credited for the appropriate amount of any charges made in error.

Rezform maintains the right to permanently ban any customer who fails to complete a payment that is proven to be correct. Any outstanding charges will be pursued.

Anti-Spam Policy

You are responsible for complying with any and all appropriate anti-spam regulations, including but not limited to the CAN-SPAM Act, GDPR, and TCPA for SMS communications.

We require that:

• • Anyone who signs up through your capture page has explicitly agreed to receive SMS messages
• • You provide a clear way for subscribers to opt-out (e.g., replying STOP)
• • You do not send unsolicited commercial messages
• • You do not use our service for illegal, harmful, or deceptive purposes

Rezform maintains the right to terminate the account of any user, without refund, found to be in breach of its Terms of Service through the receipt of abuse complaints.

No Warranties or Representations

You understand and agree that the Service is provided "as is" and Rezform, its affiliates, suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement.

Neither Rezform, nor its affiliates, suppliers and licensors make warranty or representation regarding the results that may be obtained from the use of the Service, the security of the Service, or that the Service will meet any user's requirements. Use of the Service is at your sole risk.

Limitation of Liability

In no event will Rezform, MV TEST SOLUTIONS LIMITED, or its directors, officers, employees, affiliates, agents, contractors, suppliers, or licensors be liable with respect to any:

• • Direct, indirect, special, incidental, consequential, or punitive damages
• • Loss of use, loss of profits, loss of data, or loss of business opportunities
• • Service interruptions, downtime, or unavailability
• • Unauthorized access to or alteration of your data
• • Third-party conduct or content, including SMS delivery failures
• • Account termination, suspension, or restriction
• • Any other matter relating to the Service

This applies whether in an action in contract, tort (including negligence), equity, or otherwise, arising out of or in any way connected with the use of or inability to use the Service.

Maximum Liability Cap: In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability to you exceed the amount you have paid to us in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater.

Rezform shall have no liability for any failure or delay due to matters beyond our reasonable control.

Force Majeure

Rezform is not liable for failure to perform its obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity, internet, or telephone service, or any other cause which is beyond Rezform's reasonable control.

Termination of Service

Reasons for termination may include, but are not limited to: suspected violation of these Terms, suspected fraudulent or abusive activity, requests by law enforcement, extended periods of inactivity, technical issues, or at our sole discretion for any other reason.

Upon termination, your right to use the Service will immediately cease. All data associated with your account, including subscriber lists and capture pages, will be permanently deleted and unrecoverable. You acknowledge and agree that:

• • MV TEST SOLUTIONS LIMITED shall not be liable for any damages, losses, or costs arising from account termination
• • No refunds will be provided for any pre-paid subscription fees
• • You waive any claims against us relating to the termination of your account
• • We are not obligated to provide any explanation for termination

You may close your own account at any time through the dashboard settings. This will result in immediate deletion of all your data.

Intellectual Property

Rezform claims no intellectual property rights over the material such as trademarks, service marks, graphics and logos you provide to the Service. You acknowledge that Rezform owns all right, title and interest in and to the Service, including without limitation all intellectual property rights, and such rights are protected by UK and international intellectual property laws.

You agree that you will not copy, reproduce, alter, modify, or create derivative works from the Service. Other trademarks, service marks, graphics and logos used in connection with the Service may be the trademarks of other third parties. Your use of the Service grants you no right or license to reproduce or otherwise use any Rezform or third-party trademarks.

Website and Services Availability

We try to ensure continuous availability of the website and all the Services provided but accept no responsibility for the consequences of interruptions or delays, however caused. Rezform will work within reason to ensure this amount of down-time is limited. We may, additionally, alter the design and specification of the website or Service at any time.

Use of the Services

You will not violate or attempt to violate the security of our website or the Services. You will not hack into the website, Rezform's computer systems or the computer systems of other users of the Services. Hacking means unauthorised access, malicious damage and/or interference and includes, without limitation, mail bombing, propagating viruses, worms or other types of malicious programs, deliberate attempts to overload a computer system, broadcast attacks or any other method designed to damage or interfere with the operation of a computer system or website.

Conditions

We may alter or terminate our services at any time, for any reason, and without notice. We maintain the right to alter these Terms of Service at any time without notice. Please review these Terms of Service on occasion as they may change in the future.

We may, but have no obligation to, remove accounts and content containing what we determine as unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable material. We will remove content that violates any party's intellectual property or these Terms of Service. An account terminated by Rezform will not be backed-up for any reason and will be immediately deleted from our servers.
